Criminal Record Searches & The Fair Credit Reporting Act
The Fair Credit Reporting Act (FCRA) requires that prior to making an adverse employment decision that all criminal information, such as those obtained from a Multi-Jurisdictional Criminal Record Database, be verified directly at the source.  It's important for clients that utilize the Multi-Jurisdictional Criminal Records Database (also referred to as the National Criminal Database) to verify all criminal records using an On-Site County Criminal Search.  Criminal Records Databases are third party databases consisting of collected criminal record data.  This criminal record data is often updated on various schedules, with most jurisdictions updated on a monthly basis with the most current data available.  This means that the data available at the courthouse will be the most current and accurate information available.  We encourage Human Resources professionals to utilize both the criminal records databases and the On-Site County Criminal Records.
